These products and services shall collectively be referred to as (the "Products/Services") in the rest of this document.
Your access to and use of the Products/Services is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Products/Services.
By accessing or using the Products/Services you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Products/Services.
You agree to defend, indemnify and hold harmless MioTherapy and its subsidiaries, agents, licensors, managers, and other affiliated companies, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) your use of and access to the Products/Services; (ii) your violation of any term of this Agreement; (iii) your violation of any third-party right, including without limitation any right of privacy, right of publicity or Intellectual Property Rights; (iv) your violation of any applicable law, rule or regulation; (v) your User Content or any that is submitted via your account; or (vi) any other party’s access and use of the Products/Services with your unique username, password, or other appropriate security code.
The Health Insurance Portability and Accountability Act’s (HIPAA) medical privacy regulations govern the use and release of a patient's personal health information, also known as protected health information (PHI). Under the HIPAA privacy regulations, patients must be informed about how their PHI will be used and given the opportunity to object to or restrict the use or release of their information.

("MIO","MIOTherapy",MioTherapy","Mio Therapy","MIO Therapy") recognizes the importance of protecting the privacy of visitors to its website and the PHI collected where MioTherapy’s software product is the data controller. We take reasonable steps to keep the PHI we possess secure and to delete unnecessary PHI. Below you will find MioTherapy’s notice of privacy practices. If you wish to purchase any product or service, you may be asked to supply certain information relevant to your Purchase.
Unless otherwise stated, all sales are considered final and non-returnable. You must be 18 years of age or older to purchase any Products from MioTherapy. All prices for Products are in USD, and are exclusive of any applicable local, state, or federal taxes. Shipping and handling fees, if any, will be reviewable prior to submitting your order.
All payments through the Products/Services are processed using a third-party processor. You acknowledge that MioTherapy is not liable for any breaches of credit card or debit card security or privacy by such third party processor. You agree to pay all charges incurred by users of your credit card, debit card, or other method of payment. Due to potential fraud and misuse, we may decide not to ship an order, or request additional verification information for payments. ACH, Wire, Credit/Debit Cards and Paypal payments must clear the authorization process and will be charged immediately; we will not ship until the payment clears.
MioTherapy will ship all Products purchased through the Products/Services to the address specified in the shipping address section of the order form. Shipments will be made via USPS, UPS, or your own carrier unless otherwise specified at the time of purchase (or at the discretion of MioTherapy). The time period from order to delivery will vary depending on location. MioTherapy ships worldwide. MioTherapy is not liable for lost, misdelivered or damaged shipments. MioTherapy assumes no liability for the address information provided by you. You are responsible for all fees associated with missed deliveries, miss-labeled packages, and undelivered packages. You are responsible for ensuring that the address provided is correct. You are responsible for any VAT, tariff, duty, taxes, handling fees, brokerage charges, customs clearance charges, etc. required by your country for importing consumer goods. All invoices are automatically generated; please do not contact MioTherapy for invoices or additional information regarding your purchases. Check your spam or trash folder in your email for automated invoices and shipping tracking information.
Any product purchased from MioTherapy Inc. will come with a 30 day limited warranty unless otherwise stated. MioTherapy will replace or repair merchandise purchased online that is DOA (Dead On Arrival) up to 30 days after purchase with a valid RMA #. Please contact our customer support to request an RMA.
When you visit the website, we may also collect certain technical information relating to users, which your web browser automatically sends whenever you visit a website on the internet or which is collected when you use a mobile application. Our servers automatically record this information, which may include Internet Protocol ("IP") address, browser type, browser language, device type, the date and time of your request, and Uniform Resource Locators, or URLs (i.e., website addresses) visited prior to visiting and after leaving our website. Depending on a user’s country and the specific information involved, this technical information may or may not be Personal Information.
MIO Software License Agreement
All apps, software, or any kind of code provided by MioTherapy will be henceforth be referred to as "the Software".
By downloading or using any of the Software, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the Software. You’re not allowed to copy, or modify the Software, any part of the Software, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the Software, and you also shouldn’t try to translate the Software into other languages, or make derivative versions. the Software itself, and all the trade marks, copyright, database rights and other intellectual property rights related to it, still belong to MioTherapy Inc.
